India’s patent appeals board, the Intellectual Property Appellate Board has denied American company Monsanto Co. a patent for a genetically-engineered method of increasing climate resilience in plants. The Board states that the technology is a discovery of a new property of known substance and does not qualify as an invention under the Indian Patent Act. The Board used Sections 3(d) of the Patent act as well as 3(j), used for the first time to specify that plants and animals are not patentable. Monsanto co. released a statement stating they will evaluate possible further actions and believes that “patent protection is a must.”
